MASSACHUSETTS PAY TRANSPARENCY ACT ALERT

Beginning October 29, 2025, employers with 25+ employees in Massachusetts will be required to establish and disclose pay ranges in job postings and to disclose pay ranges to employees who request this information. A pay range is defined as “the annual salary range or hourly wage range that the employer reasonably and in good faith expects to pay for such a position at that time”.

Employees or prospective employees will have a right to know the pay range for a position when applying for that position, upon a promotion, a transfer, or beginning a new position, or upon request for their current position. Covered employers are prohibited from retaliating against employees who request this information.

The new law requires employers with 100+ employees to report their EEO Data Reports to the Secretary of the Commonwealth in addition to the current requirement to file these reports with the federal government.

The Massachusetts Attorney General’s Office enforces this new law and is authorized to impose fines and penalties for violation of this law.
